Philifoth Ltd

Terms of Use and Service

Effective date:

1. Agreement and scope

These terms govern access to Philifoth Ltd websites, accounts, subscriptions, software, digital services and related support. By using a service, creating an account or placing an order, you agree to these terms and any service-specific terms presented to you. If you act for an organisation, you confirm that you are authorised to bind it.

A product described as planned, in development, preview or coming soon is not an active service and does not create a commitment to release it.

2. Accounts and security

You must provide accurate information, keep it current, protect credentials and use available security features appropriately. You are responsible for activity authorised through your account and must promptly report suspected unauthorised access. You may not create accounts through deception, impersonation or automated abuse.

3. Orders, subscriptions and billing

Prices, currency, billing period, taxes and included features are shown before an order is confirmed. Recurring services may renew for the disclosed period unless cancelled before renewal under the applicable service process. You authorise the selected payment provider to process amounts properly due.

A payment acknowledgement does not by itself confirm activation where identity, availability, domain, risk or provider checks remain outstanding. Failed, reversed or disputed payments may delay or suspend the associated service.

4. Cancellations and refunds

Cancellation and refund eligibility depend on the service, fulfilment status, third-party costs, disclosed plan terms and mandatory consumer law. Completed domain registrations, renewals, transfers, personalised work and other irreversible third-party transactions may be non-refundable where permitted by law. Nothing in these terms removes rights that cannot lawfully be excluded.

5. Domains and third-party services

Domain availability is not guaranteed until registration is confirmed by the relevant registry or registrar. You are responsible for accurate registrant details, renewals, transfer approvals and compliance with registry policies. Hosting, payment, email, domain and other third-party services may be governed by additional provider terms and technical limits.

Philifoth is not responsible for a third party's independent systems, content or decisions, but will perform its own agreed obligations with reasonable care.

6. Acceptable use

You must not use Philifoth services to break the law; infringe rights; distribute malware; send unlawful or unsolicited communications; deceive, harass or exploit others; interfere with systems; evade security or usage controls; scrape private information; or host content or activity that creates material security, legal or operational risk.

Reasonable technical limits, fair-use controls and abuse-prevention measures may be applied to protect customers, providers and the platform.

7. Content and intellectual property

You retain rights in content you lawfully submit. You grant Philifoth the limited rights necessary to host, process, transmit, back up and display that content to provide the selected service. You confirm that you have the required permissions and remain responsible for your content.

Philifoth names, designs, software, documentation and original service materials remain owned by Philifoth Ltd or its licensors. No ownership is transferred except where a written project agreement expressly says otherwise.

8. Availability, changes and support

We work to provide reliable services but do not promise uninterrupted operation unless a specific service-level commitment says so. Maintenance, security events, provider failures, internet conditions and circumstances outside reasonable control may affect availability. Features may change where reasonably necessary for security, law, compatibility or product improvement.

9. Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary for non-payment, legal compliance, security, abuse, material breach, provider requirements or protection of users and systems. Where appropriate, we will provide notice and an opportunity to remedy. You may stop using a service or cancel it through the available process, subject to outstanding obligations and irreversible transactions.

10. Disclaimers and liability

Services are provided with the level of care required by applicable law and any express service commitment. To the extent permitted by law, implied warranties not capable of applying to the service are excluded. Philifoth is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by customer action, unlawful content or an independent third party.

Liability that cannot legally be excluded or limited remains unaffected. Any contractual liability cap stated in service-specific terms applies only where lawful and appropriate to that service.

11. Privacy

Our Privacy Policy explains how Philifoth Ltd handles personal information. A service may provide additional privacy information when its processing differs from the main website or account service.

12. Governing law and disputes

These terms are governed by the law that applies to the contracting Philifoth entity and transaction, without removing mandatory protections available in your location. Before starting formal proceedings, the parties should attempt in good faith to resolve a dispute through the published support or legal contact channel. Courts or tribunals with lawful jurisdiction may hear unresolved disputes.

13. Changes and contact

We may update these terms for legal, security, operational or service changes. The effective date identifies the current version. Material changes affecting an active service may also be communicated through an account or service notice.

Questions about these terms may be sent to [email protected]. Service support is available through support.philifoth.com.
